Jean-Marc Fournier, who until this week was working as an adviser to federal Liberal Leader Michael Ignatieff, will replace Kathleen Weil.
Fournier, who does not have a seat in the legislature, has to win a byelection in a Montreal-area riding.

I am now unamazed at the degree of ignorance Canadians have regarding the civic system. A cabinet minister is a member of the government. Am MP/MLA/MPP/MNA etc are members of the legislature.
Her Majesty may appoint ANYONE over the age of 18 to be a minister of the Crown (the minister must be old enough to sign contracts). He/she may adminster the Acts assigned to the minister without reference to the legislature EXCEPT when the minister's authority to spend money from the treasury lapses or is exhausted and, if the minister wishes the Acts amended. Then the minister must request more spending authority by presenting an appropriation bill for money or some other bill for changes to the statute to the legislature.
Nothing in the any Act states the minister must be a member of the legislature. They usualy are members as it makes it easier to ask and get money, but it is not required.
These rules came about in 1688 as part of the Glorious Revolution and are nothing new. Except to people who attended most public schools.

First, the PM is not elected. He is appointed. The only people who voted for PMSH lived in Calgary South West. BTW, there are no statutes that require a PM to administer so the Crown does not need to appoint a PM (of course the GG will need to do all the work the PM does). In theory, the Crown could appoint you as PM and have me as the Minister of Defence and your girlfriend as Minister of Finance etc.
A good idea? No, as when the spending approriations end on March 31 of each year the appointed government may have some problems getting the legislature to appropriate more funds for the new fiscal year and if the government wants changes to any statutes they must first convince an MP/MPP/MLA to introduce the bill to amend the Act. At that time the legislature will extract all sorts of consessions before granting the government's requests. That was the idea behind money approriations lapsing at the end of the year. The Crown MUST recall Parliament at least once a year to get more cash.

Prior to the Glorious Revoltion, PM's and Ministers were seldom members of the H of C (House of Lords yes but NOT commoners). In Canada, Chretian appointed Pierre Pettigrew as a Minister (I believe it was intergovernmental affairs ie the constitution) and he was minister for several months before a by-election could be arranged for his election to the House. It did make his job difficult.
Why we like ministers to be members of the HofC is we want at least a veneer of demoncracy. Also, even in a safe seat, a person must have some appeal to regular folks to be elected. Pettigrew won the by-election and again in the next general election but was turfed from a safe Liberal Quebec seat in the second general election. He came across as the egg head he was and the voters finally said enough.
PM's have the double issue of a) convincing enough party members to let them lead the party and b) not being so out of touch a general electorate can't stand them. That's why Iggy is having a tough time. Only the blue bloods of Rosedale have elected him (as an MP). The average Liberal in east end Montreal, Fishing Cove NB or Tractor Rut, MB hasn't selected him as party leader and most likely would never do so.
