Never a rubber bullet around...

...when you really, really need one...
For University of Toronto adjunct professor Peter Rosenthal, a lawyer who has participated in several trials involving Taser deployments, anything that can stun people or crowds should be considered dangerous.
Hey, Peter... you mean like Michael Ignatieff trying to explain why MP's shouldn't have to make their office budgets public?

Yup... this infernal device oughta scare the crap outta anybody who's never been to a rock concert.

Hmmm... Peter Rosenthal... that sounds so familiar... isn't that the guy who represents uber-spokes-native Shawn Brant?
"Peter Rosenthal, a Toronto-based social justice lawyer representing Brant, argued that conditions now are different from when Brant agreed on May 3 not to plan or participate in illegal protests."
Nice to know the "Red Star" has all these impartial experts at their fingertips, huh?

Ignorant thug attempts to intimidate...

...Conservative MP... fails miserably...
MP Daryl Kramp says he refuses to be intimidated by Mohawk protester Shawn Brant's warning that the Conservative member is "not welcome on Mohawk land." Brant confronted Kramp at a sod turning event Saturday for the new skateboard park at Tyendinaga Mohawk Territory.

Kramp said the confrontation with Brant was fully expected based on the man's history. He said someone with a legitimate concern should discuss it rather than disrupt what was supposed to be a celebratory event.

"He thinks he can intimidate anyone he runs across and, obviously, that's not the case." Kramp said. He said Brant's comment "displays a shocking amount of ignorance."

Just what does it take...

...to be a much-celebrated hero in multi-culti Canada?
"He's described as a reluctant warrior because he carried himself with integrity and honour and dignity and I think he was particularly inspiring for so many of us."
Just don't expect to get the whole story from the fuzzy-bunny Canadian media.

See... when Donald Marshall and his buddy Sandy Seale tried to rob crazy old crank Roy Ebsary... they didn't count on Ebsary fighting back and stabbing Seale to death. Or that Ebsary would then tell the cops it was Marshall who killed Seale.

Sure, it wasn't fair... but that's what criminals do... they lie.

More to the point though, it didn't make Marshall the innocent bystander he claimed to be. The truth is, at 17 years of age, he was a conscienceless thug looking for an easy payday. If he or Sandy Seale were more competent criminals, it could just as easily have been Roy Ebsary who got gutted like a fish.

It certainly would have been interesting to see what Donald Marshall would have said then, because... as I said earlier... criminals invariably lie.

Anyway... after his conviction was repealed, ol' Donald got a lifetime pension of $1.5 million to... you know... compensate him for his burgeoning criminal career that had been so rudely interrupted. And that's actually what allowed this "reluctant warrior" to begin to champion aboriginal causes... instead of resuming his former career as a mugger.

Donald Marshall did get convicted for the wrong crime that day... but he was certainly no innocent bystander. And the system, which certainly isn't perfect, did compensate him for that mistake.

Now, I know voicing this will likely push the leftosphere into another spluttering, spittle-flecked rage about systemic racism... but those are simply the facts.

And, oh yeah... just one other little missing factoid.

There's not a single whiff about this "aboriginal icon" being charged with attempted murder a couple of years ago... after he tried to run a guy over with his car.

What kind of sentence you figure you or I would receive for that type of thing?

I'm gonna take a flyer and bet it wouldn't be an aboriginal "healing circle".

UPDATE: CBC continues to rewrite history

Today (Sun Aug 9) CBC radio has one of Marshall's lawyers on talking about the case. The lawyer constantly refers to poor Donald as "Junior"... evoking the image of a small helpless boy.

She also characterises the attempted robbery of the elderly Roy Ebsary as a viscious "racist attack" on Marshall and Sandy Seale. No hint of criminality on the part of the two young thugs.

Not a single, solitary word about his 2006 arrest for "attempted murder" or the charges of assaulting his wife.

Yeah... I'm shocked.

Live and don't learn... that's us

Someone please explain to me why Shawn Brant isn't cooling his heels in jail.
-- DESERONTO -- Native protesters led by Shawn Brant blocked both ends of the Skyway Bridge near Deseronto Sunday evening, claiming the move was in support of First Nations members in Akwesansne.

Traffic is being turned away from the scene by provincial police, meaning anyone looking to cross into Prince Edward County — or from the county into Deseronto — will have to travel to the Norris Whitney Bridge in Belleville.

Brant said the protesters are in for the "long haul," and will be staying on scene until the government opens talks with the people of Akwesansne. He said he expects more people to show up to join the protest later in the day.
Try this sometime yourself. Get a whole bunch of your friends and try to shut down a public highway.

See how long it takes the local cops to drag your non-aboriginal ass off to lockup.
Members of the Akwesanse First Nation have been engaged in a protest that has led to the closure of the Seaway International Bridge, which spans the St. Lawrence River.

Protesters say they're worried arming border guards at the Cornwall Island border crossing could lead to violence on their land.

There have been no reports of injuries or clashes between police, the protesters or the public to date at the protest in Deseronto.

Turns out our racist white society...

...is the least of their worries...
When Austin Fuller joined the military shortly before the Second World War, he knew what he signed up for. In a Belleville courtroom earlier this month, however, someone signed the 87-year-old veteran and his wife Catherine up for a fight neither want to be a part of.

According to court documents, the elderly Mohawk couple are named among those who have launched a $3.3-million civil action lawsuit that levels accusations of nepotism, abuse of power and various other conspiracies purported to have been carried out by the Mohawk band council and senior levels of government.

Speaking to The Intelligencer Monday, the couple claim they were never consulted by anyone about joining the lawsuit -- and only found out through the media that they were named as plaintiffs.

"We didn't know a darn thing about it and we never gave anyone permission to use our names in this," said Austin Fuller, who was one of 11 Second World War veterans from the Hastings and Prince Edward Regiment to travel to Italy three years ago to pay homage to fallen comrades.

As for the current fight, Austin simply called it "ridiculous."
So what kind of person would drop an elderly couple into the middle of this mess?
The most well-known protester of the group, Shawn Michael Brant, has yet to be taken into custody by police on the reserve -- despite an arrest warrant being issued more than a month ago for his alleged role in the incident.
Of course... Shawn Brant.

It's a No-Brainer

How smart do you have to be... to realise that the lack of a proper education, especially in today's knowledge-based economy, will make or break your child's future?

In fact, here in Canada, without that piece of paper, you can be condemning yourself to a lifetime of menial, low-paying jobs... or worse... a life of penury.

And, what exactly, is the deal with Canada's aboriginal communities?
Using data from the 2006 census, Prof. Richards demonstrates that a high-school diploma makes any Canadian, whether aboriginal or not, nearly twice as likely to hold a job.
That just makes sense, right?

So can anyone explain why so many fewer native children are failing to achieve the most basic of educational footholds... the high school diploma?
But for aboriginal people aged 20 to 24, the group that most recently went through the Canadian school system, barely 60 per cent have completed high school, compared with nearly 90 per cent of non-aboriginals.

That rate drops to nearly 50 per cent among those that identify themselves as first-nations members, as opposed to Métis or Inuit, and declines to less than 40 per cent for those living on reserves.
Now... this is where Zorpheus and Rob Budde and Dr Dawg all jump in and start to sing a merry song of racism.

But hey, guys... hang on just a second.

Other so-called visible minorities, immigrants who come to this country penniless and without even basic English language skills, are blowing right past aboriginals... grabbing hold of that idealised Canadian dream and becoming wildly successful.

This isn't about race and racism... it's about culture.

It's about a culture of defeat, a culture of victimisation.

And don't tell me there are no opportunities for aboriginal people. The taxpayers of this country pour 10 billion dollars every year into trying to float that shoddy, leaky First Nations cultural boat. If native children manage to get that high school diploma, there are, in this uber politically-correct environment, companies and government programmes that will fall over backwards to help them get ahead.

Just ask folk hero and convicted criminal Shawn Brant about his $430,000 government loan, which... by the way... he defaulted on.

Stop pissin' and moanin' and get your collective asses in gear... because it's not just your lives you're wasting.

Do it for your kids.

Local Scam-Artist...

...ducks serious jail time... yet again...
-- BELLEVILLE -- The aboriginal protester behind a blockade that shut down Canada's busiest highway during last year's aboriginal day of action was spared further jail time after an unexpectedly speedy trial today.

The Belleville Intelligencer reports that Mohawk protester Shawn Brant was charged for shutting down Highway 401 in eastern Ontario in June 2007 as well as for another blockade in the area on April 20 that year that halted CN Rail's main line.

In an unexpected move, what was to be the start of three weeks of pretrial motions in the case turned into a 30-minute trial.

RELATED: Shawn Brant... aboriginal role-model

You know how ol' Shawn always tells the media he's a cabinet-maker? Well, strangely enough, that's not quite the whole story.
Justice Lynn Ratushny describes Shawn Brant's actions in the dispute as those of a deceptive, self-serving man who played the role of victim and failed to take responsibility for himself.
To his credit, he's an equal-opportunity criminal... no issues at all screwing over his own family, friends and community.
The Brants went ahead and erected a building on the property. Their business failed within one year and none of the $430,000 in loans was repaid.
And that's not all. In the never-ending battle against racist Canadian society... Super Shawn's not afraid to get his hands dirty...
Brant jumped out of his car, grabbed a six-foot-long fishing spear from the rear seat and ran towards the altercation, Lalonde said.

"His eyes were crazy-looking ... he was in a rage," he said, adding Brant ran up to the scene yelling "'Is it on? Is it on?'"
Whoa... a guy with a criminal record attacks someone with a spear... that's serious business right?
After two days of evidence into the matter -- which centred around an April 21 incident near the corner of Bells and Lower Slash roads -- Justice Stephen Hunter said he found "sufficient evidence" to convict Brant, 44, of carrying a dangerous weapon and breaching court-imposed conditions.
So... holy crap... looks like he's finally pushed his luck too far.

Well... not exactly...
Brant was also given one year of probation with strict terms, including conditions that he is not to participate in or plan protests.
Let's not forget the punchline here...
"During his probation, he is banned from participating in or organizing any unlawful protests and owning weapons — with the exception of those used for aboriginal hunting and fishing."
I guess Orwell was right... in Dalton McSlippery's Ontario, anyway... some animals are more equal than others.

Funny how the television networks...

...decided to constantly gloss over this part of the story...
Justice Lynn Ratushny describes Shawn Brant's actions in the dispute as those of a deceptive, self-serving man who played the role of victim and failed to take responsibility for himself.
And, in this instance, it's not just the wily white man that Brant is at war with. This time he gave his aboriginal brothers a royal screwin' over, too.
The long-running dispute between the Mohawks of the Bay of Quinte community and the Brants involves a piece of land where the men started a cabinet-making business in 1992. They received $430,000 in loans from an aboriginal financing company and Industry Canada for the start-up. Despite the sizable loan, Shawn Brant scoffed at the $8,700 purchase price his father negotiated for the land and instead offered $1,500.

"With the benefit of hindsight, it is evident that his initial reaction of trying to get something for less or for nothing was a foreshadowing of what was to come," Judge Ratushny writes.

The band refused the offer and a deadline for the purchase passed without event.
But even that wasn't gonna stop this noble native entrepreneur.
The Brants went ahead and erected a building on the property. Their business failed within one year and none of the $430,000 in loans was repaid.

"At times during the last 16 years, therefore, the Brants have used the lands and building almost for free, for their own purposes," Judge Ratushny writes in her decision.

"They have used hundreds of thousands of dollars from lenders for their own purposes. Shawn Brant has purported to sell that which he never did purchase and knew he did not purchase and he has kept the sale monies, for his own use."
And he's still not in jail.

Amazing.

What percentage of Ontarians...

...have actually read the Fantino/Brant transcripts... as opposed to all the deadheads who settle for a 30 second soundbite... from someone like talking head Lisa LaFlamme?

Do yourself a favour... and just plow through this one article... and try tell me Julian Fantino did anything wrong...
In quotes taken from OPP transcripts (posted on The Intelligencer's website at www.intelligencer.ca), Fantino warns even natives are turning away from Brant and his theatrics and headline-grabbing protests that do little to advance the legitimate concerns of First Nations people.

Fantino was blunt in his assessment of Brant's activities:

"So, whatever message you've been putting out about children's suicides and poverty and the water," Fantino said in the cellphone exchange, "all that's all gonna be lost in the rhetoric where people are just gonna absolutely despise you and hate you that they're not gonna hear anything you've said about all those wonderful causes you're talking about.

"So, I've talked to enough people now, including a lot of people in the First Nations community ... they are running for the hills because you're bringing them down ... bringing down all the gains that you've made over the years and now (that) the struggle is starting to have some effect, you're destroying that because the message now is gone from a cause to a vengeance -- a vindictive ... Shawn Brant is going to bring Canada to its knees. Well, you're not gonna do it and your cause ... you can speak about children committing suicide all you want because nobody is going to listen to you.

"And, you know I don't wanna get on your bad side, but you're gonna force me to do everything I can within your community and everywhere else to destroy your reputation. I don't wanna do that, I wanna help you deal with the suicides ... I've travelled to reserves ... I know exactly what you're talkin about.

"I've been to Kashechewan and some of those other places there, I've been involved in... so you're talking to someone that's sympathetic here so I'm imploring upon you to call it quits."

"Let's do it now."
Yup... that's some villain.

So, according to the Globe...

...this young man can first be characterised as a vigilante... then ridiculed as a parody of a comic book character.
-- VANCOUVER -- An eye-gouging fistfight between a good Samaritan and a purse snatcher has prompted Vancouver police to offer qualified support for "vigilante action", suggesting citizens should feel free to "indulge their inner Batman" if they have the martial and physical skills to prevail against bad guys.
Well... at least there's no confusion about where they stand.

I couldn't initially get my head around the apparent role-reversal in this so-called reporting. Apparently, according the Globe & Mail, the man who committed the criminal act is suddenly, magically... the victim of a vigilante.

UPDATE: Brant found guilty, then set free
Mohawk protest leader Shawn Brant was found guilty on two criminal charges Thursday at the close of a trial that heard details of an intense roadside confrontation between a Napanee family and native protesters near Deseronto.

Hmmmm... you've got previous criminal convictions... you're, in fact... out on bail... and you throw a spear at someone.

That's pretty serious shit, right?

Apparently not if you're aboriginal.
Brant was also given one year of probation with strict terms, including conditions that he is not to participate in or plan protests. However, he is permitted to attend meeting of the Mohawks of the Bay of Quinte band council or activities "initiated by police services."

In addition, Brant was given a five-year weapons prohibition, but "will be permitted to have traditional native fishing (equipment) and will be allowed to hunt," using firearms while on the reserve, said Hunter.
Of course, to get a walk like this... there obviously must be mitigating circumstances...
Defence counsel Howard Morton, who early in the proceedings leveled accusations that provincial police were looking for any way to pin charges on his client, called no evidence or witnesses to bolster his case during the trial.

"There was no doubt in my mind he would have stabbed me with it ... he had a crazy look in his eye." As he retreated to his truck, Lalonde said other protesters from up the road were arriving at the scene. "I told Michael to get in his truck and leave, which we did ... we left pretty quickly, of course."

As the two trucks sped away, Brant threw the fishing spear at Lalonde's truck like a javelin thrower, he recalled.

The spear struck the rear tailgate of his vehicle, he added.

It's past time to shut these sociopaths down.
-- DESERONTO, Ont. -- Mohawk protesters and provincial police officers were involved in a tense standoff in Deseronto, Ont., on Friday after officers said they spotted at least one gun among the demonstrators.

Police say they spotted a ‘long gun' being pointed at them from a location inside an occupied quarry, which protesters have controlled since March, 2007.

An order was issued to all police personnel on the scene to take cover, and guns were drawn by officers crouching behind their vehicles, but no shots were fired.
Spokes-native Jason Maracle is apparently threatening another Oka...
“We're not moving anywhere,” he said. "I guess if they want another 1990 scene, then OK, I guess we'll have one.”

A Quebec provincial police officer was shot and killed when a SWAT team stormed the barricade.

Don't believe me? Try this experiment some time yourself... occupy someone else's property by force... and then point a rifle at some cops... see if the local SWAT Team doesn't drop you like a crazy ex-girlfriend.

Bury my Wallet at Wounded Knee

I don't very often post a newspaper article in its entirety... but if you actually have any vestigial illusions that we are living in a free, democratic, capitalist country... do read on...
A Kingston-based realtor says construction crews will return to property owned by his family in Deseronto next week, despite a confrontation with natives there days ago.

Emile Nibourg told The Intelligencer he plans to have crews return to the site April 21 to finish cleaning brush there, even though one of his employees was approached by Mohawks who questioned what he was doing on what one native termed "my" property. The situation quickly escalated to involve "40 to 50 native warriors," as Nibourg called the men, members of the Ontario Provincial Police and Nibourg and his father.

The event ended peacefully when Nibourg, his father and the employee agreed to leave the property with police.

Nibourg has since written a letter to the area's MP and MPP, explaining his frustrations and promising a crew of "25 to 30 guys" will return to the site next week.

"The problem is we have legal ownership to it, but the government doesn't seem to want to do anything," Nibourg said. "They don't even want to talk to us."

Nibourg said it is frustrating that his father - who holds title to the land - cannot access it. In a letter to Prince Edward-Hastings MP Daryl Kramp, Nibourg said "between property taxes, interest and other expenses with the property we are spending in the vicinity of $100,000 per year."

The property in question is partly in the Town of Deseronto and partly in the Town of Greater Napanee. The property is approximately 18 acres with 1,300 feet of waterfront.

Nibourg said his father's company, Nibourg Developments, was ready to develop the property two years ago, but when land claim disputes erupted surrounding the Culbertson Land Tract, plans came to a halt. Two years later, he said, the waiting continues.

"What am I supposed to do? We have a very, very large sum of money tied up in that property and we own it, but we can't do anything with it? We're entitled, as owners of that land, to do work there," he said.

Deseronto Deputy Mayor Clarence Zieman said he had not heard of Nibourg's intentions to return to the site next week, but expressed concern about a potential showdown.

"That does not sit well," he said after hearing Nibourg's plan. "I don't disagree with him, it's his property."

Zieman also sympathized with Nibourg's frustrations over the government's claim that it is business as usual. He said it obviously is not and pointed to the planned expansion of the Parkview Apartments senior complex as an example. A protest disrupted a site meeting the County of Hastings held at the Deseronto home on March 31 for contractors interested in bidding on repair work.

The county opted not to proceed with any work for fear of causing further protests.

"We cannot do any development at all until this thing is settled," Zieman said. "Mr. Nibourg has a nice piece of property that he wants to develop. It would help our town and it wouldn't hurt the Mohawks one iota."

But the deputy mayor said if Nibourg stays true to his word and sends a crew to the site Monday, "it's going to end up as a major problem."

Nibourg has a meeting scheduled later this week with Insp. Patt Finnegan, detachment commander of the Napanee detachment of the OPP, to discuss the situation, but said he has already made plans for crews to revisit the site.

Such moves have cost developers in the past.

It's been just over a year since Mohawk protesters erected a make-shift village on land owned by Thurlow Aggregates owner Terry Kimmet. Thurlow Aggregates is the Deseronto Road quarry business that spurred several demonstrations last year after protesters learned it was operating on disputed land. A group of Mohawks are blocking entrance to the site, vowing to stay until its licence is revoked.

Nibourg said he's hoping the same doesn't occur on his property.

"I really hope it doesn't," he said, adding he has no plans in place in case his actions Monday erupt into a similar circumstance.

In the interim, Nibourg has mailed his letter to government representatives and has met with Kramp to discuss his concerns. He said the federal government is telling everyone it is "business as usual" but that's far from the truth.

"We do not have clean title. We do not have the luxury of business as usual. We don't even have the right to go onto our property," he said in his letter.

Nibourg said he is not blaming the Mohawks. He said the federal government has accepted the claim as valid giving the natives the right to say the land is theirs but, he argued, so does his father. The government must take action to alleviate the "volatile situation."

"If it's their land, fine. They could come talk to us and compensate us but for the government to say it's business as usual... It's not."

Though Kramp's office said the MP was not available for comment, his legislative assistant, Jessica Maga, said Kramp is looking into the issue.

"He is working on it. It's an important file and he's giving it a lot of attention," she said.

MPP Leona Dombrowsky was not available for comment on the matter.
**********

FROM THE COMMENTS:
"The government of Upper Canada granted ownership of +/-800 acres to John Culbertson (a part Mohawk) in 1837. Culbertson was the grandson of John Desorontyon - the Mohawk chief to whom the entire eastern land grant to Mohawks was made."

"Culbertson's descendants subsequently sold the land to others for currency. And now it is being claimed back (an action not being led by other Culbertson descendants but by third parties of indistinct genealogy)."

"If Culbertson did not have clear title to sell the property, than a fraud was committed when he did so."

We shouldn't feel slighted

Apparently Shawn Brant doesn't give a crap for Mohawk rules and regulations either...
A judge has returned control of a disputed Deseronto-area building and lands to the local Mohawk band council, but a defence lawyer says his clients will appeal the ruling.

In a judgment released Wednesday, Justice Lynn Ratushny of Ontario's Superior Court of Justice ruled the building and lands must be returned to the Mohawks of the Bay of Quinte (MBQ) band council.
It does appear though, that not all the Mohawks have rejected the jurisdiction of the wily white man's courts.
The case had been brought by MBQ Chief R. Donald Maracle on behalf of band council and all band members against Shawn M. Brant, his father, Ronald L. Brant, Andrew Clifford Miracle and Ohwistha Capital Corp.

The lands were occupied and the building built by the Brants, then sold to Miracle - though the judge wrote neither the Brants nor Miracle ever had band council's consent.
**********

RELATED: Shawn Brant, aboriginal hero...
Ratushny, in her written ruling, explained that in 1992 the Brants approached the band with an offer to purchase the property in question.

Though they did not purchase or pay for the lands, they did borrow hundreds of thousands of dollars from Ohwistha - an Aboriginal finance company that administered development loans for native businesses - and from Industry Canada to help them construct buildings there.

None of these funds were repaid.

Child sacrifice

It ain't just for crazy jihadis...
On the night the protest began, as the blockades were erected and police readied themselves for a showdown, Kelley was behind the barricades with the Mohawk protesters. She said it took some convincing, but they finally agreed to let her stay with them behind their barricade lines.

The documentary also shows that Mohawk leader Shawn Brant had children at the blockades. The inclusion of the youth in the events was meant to show them that they too "may have to someday stand up and fight for what they believe in," Kelley's documentary quotes Brant.
Remember... this is the same Shawn Brant who warned OPP honcho Julian Fantino... that the aboriginals had firearms at the blockade... and were prepared to use them that night... a fact that is curiously absent from reporter Susanna Kelley's account here.
Asked if children in the protest perimeter was proper, in her experience, Kelley said, "As a journalist I'm non-judgmental about these types of things. That's up to the public to decide."
Hey, Susanna... let me help you out here... "dropping children into the middle of a potential firefight?"

It's not acceptable... EVER.

The phrase...

"Could screw up a two-car funeral"... comes to mind.
-- DESERONTO -- Four people escaped with minimal injuries in a fire at the scene of a native occupation on the northern outskirts of town here this week.

According to protester Shawn Brant, who initially led the occupation last March, the building was used as a cookhouse by natives occupying the quarry.

Tyendinaga Township firefighters initially dispatched to the scene were turned away, Brant added, only because they arrived with a "convoy of OPP (vehicles) that raised a number of eyebrows ... in large numbers. More than you would expect for a small structure fire."
Well, Shawn... perhaps it would... if it were true.
An OPP spokeswoman, however, painted a different scenario when asked about the police agency's response to the fire.

"There was a police cruiser that responded to a call," Sgt. Kristine Rae told The Intelligencer. The lone cruiser, she said, "cleared the scene when it was told it was no longer required."
No wonder all these aboriginal negotiations have been bogged down for years.

Everything seems to start with, "Once upon a time..."
