If you're a copper...

And some guy tells you he's gonna rob a bank... aren't you under some sort of obligation to keep an eye on him and maybe try to prevent it?

If you've been following the aboriginal rail blockade in Deseronto, in Eastern Ontario this week, you might not necessarily come to that conclusion.

Shawn Brant, fresh off a major disruption of Canada's busiest rail corridor, is promising more of what he likes to call, "economic disruptions" to Canadian citizenry and infrastructure alike... in the near future.
"Believe it or not, it was the first soft step of the campaign," said Shawn Brant around 8 a.m., two hours after the group removed a school bus blocking the tracks. "We have identified three different targets, and we will escalate the degree of severity as is necessary."
Bear in mind this is the very same Shawn Brant who had a spot of trouble with the local constabulary just a little while ago...
-- DESERONTO -- Charged with three counts of uttering death threats are Shawn Michael Brant, 42, of Tyendinaga.
But, you might ask, "Don't the police have to have pretty specific cause before they start keeping tabs on private citizens"?

Well, the enthusiastic, but apparently not especially bright Mr. Brant has obligingly and very publicly announced his criminal intent to the mainstream media...
Those targets are the railway, provincial highways and the town of Deseronto, Brant said as he puffed on cigarettes at the gravel quarry that is the heart of the dispute

The next target has been selected already and plans for the action are being finalized, he said.
I suspect Mr. Brant is feeling quite pleased with himself for the moment... after shutting down, occupying and looting a private gravel pit operation and then, in short order, facing down one of the largest corporate entities in Canada... with absolutely no legal consequences to himself, or his band of criminal brothers.

Not too surprisingly, the aboriginal police force seems to have taken Mr. Brant's side of things... going as far as to join him for refreshments at his illegal siege.

Although I have heard from a reliable source, that local OPP line officers are not very happy about having to stand by and watch these miscreants flouting the law, apparently those higher up the chain of command have no such issues...
"No arrests have been made at this point", said Ontario Provincial Police Sgt. Kristine Rae.

"We’re pleased that it was a peaceful resolution."
Peaceful, of course, until the day it isn't.

LAST WORD: I have a theory...
... about danger and risk-taking... it goes something like this...

Doing something stupid, or dangerous is like playing the lottery... the more tickets you buy, the better your chances of "winning the jackpot".

Right now, Shawn Brant is on a hysterical spending spree. He's won a few small prizes and now he has gambling fever...

With all the tickets he's been buying lately, I'm guessin' Mr. Brant is due for a big win. And as soon as he oversteps and engages the OPP, or another similar body in his much touted "violent confrontation"... he may find he has hit the jackpot.

Just my two cents.

No bail for Brant

Aboriginal spokes-celebrity Shawn Brant will be spending a little more time at Her Majesty's "Crowbar Motel" pending trial this fall.
-- NAPANEE -- Aboriginal activist Shawn Brant has been denied bail after a court hearing today in Napanee, Ont.

Brant's lawyers had said his respect for his mother would keep him from breaching his bail conditions and engaging in unlawful protest.
That's funny... where was all Brant's respect the last couple of times he got turned loose?
Brant, 43, had been granted bail twice before in recent months, but breached conditions of his release when he took part in protests on the Canada Day weekend.
And did anyone really think this tactic was gonna carry the day?
Though Brant had signed a May 3 court order prohibiting him from participating or encouraging any type of unlawful protest that could disrupt road, rail or waterway traffic, he had not given his word to the judge, lawyer Peter Rosenthal said.
Maybe they should have gone with the venerable "had my fingers crossed" defense instead.

You also have to wonder if having supporters show up in court looking like a Hamas murder squad, might have effected the proceedings.

I've never been on trial myself, but I'm guessing judges don't respond well to threats... implied or otherwise.

All in all... a good day for justice.

UPDATE: Meet the new left... "because we said so"
Dustin Brant, the new spokesman for the quarry protesters, said the group is feeling "frustration and anger and sadness.

But when reporters asked for reasons why Shawn Brant should be released, the younger spokesman appeared to be looking for answers from his fellow activists.

"I don't know," he said, laughing nervously.
Unbelievable.

Whatever you do...

In Dalton McGuinty's politically correct nanny-state... don't actually call a thing by it's proper name...
Native protesters swept in at 9 p.m. Thursday night and protest leader, Mohawk Shawn Brant, said they were armed and willing to use force if police intervened.

"We've made no secret that we have guns within this camp."
While the media continues to soft pedal Shawn Brant's domestic blackmail and terrorism as a "protest" or "an inconvenience..." one politician, and one only, has the integrity to call it like it is...
"You can't have people walking around with balaclavas and carrying guns," Tory said. "We have to restore and maintain respect for the law.

McGuinty has got to use the courts and every other means available to say that we just can't have the law being disrespected."
Or we're no different than the Gaza Strip.

To enforce the law of the land... when it involves aboriginals.
CN Rail expressed frustration with police for refusing to stop an illegal blockade in Eastern Ontario that disrupted the key train system that transports $100-million worth of goods along the crucial Montreal-Toronto corridor yesterday.

For the third time in 15 months, a blockade forced CN Rail to leave 25 trains sitting idle, while transport trucks were slowed on the highway and nearly 5,000 Via Rail passengers had to change their long-weekend travel plans.
Will Brant walk away unscathed again?
Presumably the OPP figured it was best to wait for Brant to surrender, which he has done in the past, rather than inflame a potentially volatile situation. But they refused to explain the decision.

"All we can say right now is that we'll execute the warrant when it's appropriate," Const. Angie Atkinson said.

Initially it was thought Brant would surrender once the blockades came down. But Brant had no plans to spend the long weekend in jail. Instead, he said he would enjoy Canada Day with his family and then turn himself in mid-week.

The usual suspects

Calling all restless, unemployed troublemakers...
Supporters for local Mohawk activist Shawn Brant will rally at the Napanee courthouse Friday when Brant faces a bail review.

Poverty and aboriginal activists will gather at the Superior Court of Justice court house on Thomas Street East to support Brant and demonstrate on Prisoner Justice Day, say messages sent out on aboriginal and anti-poverty mailing lists.
Isn't the internet wonderful?

And how is being a "poverty or aboriginal activist" now considered to be a job?

Closing down public venues, seizing private property and screaming at bystanders... has to rank somewhere close to "squeegee kid" on any self-respecting adult's resume.

One last small jurisprudential note...
Brant was already out on bail during the aboriginal day of action.

Funding for the Tyendinaga Fitness Centre includes $92,000 from the Ontario Trillium Foundation, a grant officially announced at the new fitness centre Tuesday.

It is the largest Trillium grant for the area, said MPP Leona Dombrowsky. The province recently increased the Trillium Foundation total grant amount from $100 million to $120 million.

The fitness centre contributes to a solution to the diabetes epidemic in native communities, where an estimated 27 per cent of people have it, said Carol Loft, a regional diabetes worker with the Southern Ontario Aboriginal Diabetes Initiative.

Local Scam-Artist...

...ducks serious jail time... yet again...
-- BELLEVILLE -- The aboriginal protester behind a blockade that shut down Canada's busiest highway during last year's aboriginal day of action was spared further jail time after an unexpectedly speedy trial today.

The Belleville Intelligencer reports that Mohawk protester Shawn Brant was charged for shutting down Highway 401 in eastern Ontario in June 2007 as well as for another blockade in the area on April 20 that year that halted CN Rail's main line.

In an unexpected move, what was to be the start of three weeks of pretrial motions in the case turned into a 30-minute trial.

To his credit, he's an equal-opportunity criminal... no issues at all screwing over his own family, friends and community.
The Brants went ahead and erected a building on the property. Their business failed within one year and none of the $430,000 in loans was repaid.
And that's not all. In the never-ending battle against racist Canadian society... Super Shawn's not afraid to get his hands dirty...
Brant jumped out of his car, grabbed a six-foot-long fishing spear from the rear seat and ran towards the altercation, Lalonde said.

"His eyes were crazy-looking ... he was in a rage," he said, adding Brant ran up to the scene yelling "'Is it on? Is it on?'"
Whoa... a guy with a criminal record attacks someone with a spear... that's serious business right?
After two days of evidence into the matter -- which centred around an April 21 incident near the corner of Bells and Lower Slash roads -- Justice Stephen Hunter said he found "sufficient evidence" to convict Brant, 44, of carrying a dangerous weapon and breaching court-imposed conditions.
So... holy crap... looks like he's finally pushed his luck too far.

Well... not exactly...
Brant was also given one year of probation with strict terms, including conditions that he is not to participate in or plan protests.
Let's not forget the punchline here...
"During his probation, he is banned from participating in or organizing any unlawful protests and owning weapons — with the exception of those used for aboriginal hunting and fishing."
I guess Orwell was right... in Dalton McSlippery's Ontario, anyway... some animals are more equal than others.

OPP says, "Pretty please, Shawn...

"Will you come down to the station, so we can arrest you?"
-- Thursday, May 03, 2007 @ 10:00 -- Shawn Brant will turn himself in this morning at the Napanee OPP detachment to accept charges related to blocking the CN railway near Deseronto last month.

The OPP issued a warrant for Brant's arrest in relation to the April 21 closure, which blocked the main line for 30 hours, said Sgt. Kristine Rae.

"There is an arrest warrant out for Shawn Brant," she said. "I am aware of that message going out, but he is not in custody at this time."
Notice that the illegal blockade is simply called "a closure"... you know, scheduled maintenance for aboriginal media stunts, as it were.

Mr. Brant has retained the services of lawyer Peter Rosenthal who represented the family of Dudley George at the Ipperwash proceedings. I breathlessly await the ghosts of martyred native warriors at Mr. Brant's court appearance.

A spokeman for the group that is occupying the gravel operation near Deseronto said Brant's arrest will change none of their plans...
Brant's surrender does not impact the occupation, he said. The group also feels Brant is taking heat because he has been the most visible.

"Targeting one of our speakers is an old tactic," Maracle said. "If one person goes down, another takes their place. If someone goes down on the battlefield, no one should expect the battle to stop."
You see, it's not about "criminal activity"... it's about "freedom fighters."

I can't wait for the made-for-tv movie.

What exactly do you have to do in this country... to be sent to prison?
In sentencing the Scarborough father of two to 16 months with probation and community service instead of 8-to-10 years in prison -- which prosecutors sought -- Stinson warned Tuesday of no leniency if Bryan returned to his court.

Stinson said Bryan's conviction record for 31 offences, plus the risk to police and the community were weighed against Bryan's age, apparent remorse, support from relatives and established sentencing standards for gunmen.

Toronto troublemakers and agitators...

Are talking out their asses... yet again.
The committee is comprised of many members of the Ontario Coalition Against Poverty, which also hosts the Free Shawn Brant web page.

"Shawn really fits the profile of a political prisoner," he said, adding that Torontonians he has talked with seem to support Brant's release.
Nobody I've talked to considers Brant a political prisoner. They use words like thug and terrorist. The phrase "tarred and feathered" has come up on more than one occasion.

And while that may be how they see things down at OCAP HQ... the locals beg to differ.
Residents of Deseronto, where Brant's group has occupied a quarry since March 22, feel differently, said Mayor Norm Clark.

Many residents of the frustrated town, 60 per cent of which is encompassed in the Culbertson Tract land claim currently under negotiation, had a renewed faith in the justice system when Brant was denied bail, he said.

"I would even go so far as to say that if Mr. Brant was let out, a lot of people would lose faith in the system as we know it," he said.
So OCAP may just wanna steer clear of Deseronto for a while.

Their big city "agitprop" isn't gonna sell down here.

Wanna make a good impression...

On the judge? Make sure you bring your mummy to court.
-- NAPANEE -- Brant’s mother Deanna, a retired teacher, took the stand at Brant’s bail hearing Thursday, offering a $50,000 surety that Brant would not plan, incite or participate in illegal protests between now and his court date.
I guess Shawn forgot he was already in violation of his previous bail conditions... which, for most of us mere mortals, tends to mess up any pipedream of being released on bail on a new set of charges.

Still, a crack "social justice lawyer" can't let incontrovertible facts affect his strategy...
Peter Rosenthal, a Toronto-based social justice lawyer representing Brant, argued that conditions now are different from when Brant agreed on May 3 not to plan or participate in illegal protests.
It didn't take long for the Crown to point out the holes in the defense case...
Crown attorney Bob Morrison also took Brant to task when he took the stand on his own behalf, bringing up how open Brant was about breaching his May 3 bail conditions.

“You had no intention of ever complying, did you?” Morrison asked.

“Well...” Brant said. “I actually...no.”
In the absence of any convincing evidence that Brant wasn't going to go out and blockade the courthouse parking lot that very afternoon... Judge D.K. Kirkland decided to lodge Mr. Brant at the local "Crowbar Motel" for the next 7 weeks.
“It would be dangerous for him to be released at this time because he’s said ‘there’s more to come,’” Kirkland said after a nearly three-hour session.
The preliminary hearing will be Aug. 27.

Armed Terrorists threaten OPP

Try doing this with a bunch of your buddies... and see how long it takes the local SWAT team to knock your dick in the dirt.
-- DESERONTO -- Mohawk protesters, who said they had guns and wouldn't back down, began preparations for blockades of the main CN line and Highway 401 near this eastern Ontario town late Thursday, despite widespread calls that an aboriginal day of action be peaceful.
Once again though, being aboriginal confers extra-legal status on these guys.

To no one's surprise, professional agitator and spokes-native Shawn Brant is front and centre...
Mr. Brant said he intended to lead blockades of one or both of the main traffic and rail corridors between Toronto and Montreal starting at midnight Thursday night, or before.

He wouldn't disclose the actual sites, but confirmed that he and others were prepared to “meet force with force” if police got in their way.

“We've made no secret that we have guns within this camp,” he told The Canadian Press in an interview.
This sociopath has apparently got some sort of Billy Jack looptape constantly running through his fevered brain.
Mr. Brant says the time to educate Canadians through peaceful rallies has passed.
By his own very public admission, Shawn Brant is screaming out that he is "armed and dangerous".

What more do police need to shut this asshole down?

"We're certainly in a position where we want to demonstrate goodwill," he said. "We certainly do not want to become the cause of conflict.

But having said all of that, we also have to be mindful of other people's rights and entitlements as well."

In a show of solidarity, Canadian Pacific Railways has ordered all of its freight trains to stop for one minute at 2 p.m. ET.

Shawn Brant's 'other' trial

Let's face it... in Shawn Brant's world, you're only as credible as your last "death threat."
Stringent security measures were in place as the trial of three men accused of confronting Canadian military personnel during a native protest last year began Thursday.

Shawn Michael Brant and Jerome J. Barnhart are facing several charges of uttering death threats stemming from the Nov. 15 incident east of Deseronto, in which a convoy of military students on a training mission happened upon a group of native protesters blocking Highway 2.

Funny how the television networks...

...decided to constantly gloss over this part of the story...
Justice Lynn Ratushny describes Shawn Brant's actions in the dispute as those of a deceptive, self-serving man who played the role of victim and failed to take responsibility for himself.
And, in this instance, it's not just the wily white man that Brant is at war with. This time he gave his aboriginal brothers a royal screwin' over, too.
The long-running dispute between the Mohawks of the Bay of Quinte community and the Brants involves a piece of land where the men started a cabinet-making business in 1992. They received $430,000 in loans from an aboriginal financing company and Industry Canada for the start-up. Despite the sizable loan, Shawn Brant scoffed at the $8,700 purchase price his father negotiated for the land and instead offered $1,500.

"With the benefit of hindsight, it is evident that his initial reaction of trying to get something for less or for nothing was a foreshadowing of what was to come," Judge Ratushny writes.

The band refused the offer and a deadline for the purchase passed without event.
But even that wasn't gonna stop this noble native entrepreneur.
The Brants went ahead and erected a building on the property. Their business failed within one year and none of the $430,000 in loans was repaid.

"At times during the last 16 years, therefore, the Brants have used the lands and building almost for free, for their own purposes," Judge Ratushny writes in her decision.

"They have used hundreds of thousands of dollars from lenders for their own purposes. Shawn Brant has purported to sell that which he never did purchase and knew he did not purchase and he has kept the sale monies, for his own use."
And he's still not in jail.

Amazing.

Live and don't learn... that's us

Someone please explain to me why Shawn Brant isn't cooling his heels in jail.
-- DESERONTO -- Native protesters led by Shawn Brant blocked both ends of the Skyway Bridge near Deseronto Sunday evening, claiming the move was in support of First Nations members in Akwesansne.

Traffic is being turned away from the scene by provincial police, meaning anyone looking to cross into Prince Edward County — or from the county into Deseronto — will have to travel to the Norris Whitney Bridge in Belleville.

Brant said the protesters are in for the "long haul," and will be staying on scene until the government opens talks with the people of Akwesansne. He said he expects more people to show up to join the protest later in the day.
Try this sometime yourself. Get a whole bunch of your friends and try to shut down a public highway.

See how long it takes the local cops to drag your non-aboriginal ass off to lockup.
Members of the Akwesanse First Nation have been engaged in a protest that has led to the closure of the Seaway International Bridge, which spans the St. Lawrence River.

Protesters say they're worried arming border guards at the Cornwall Island border crossing could lead to violence on their land.

There have been no reports of injuries or clashes between police, the protesters or the public to date at the protest in Deseronto.

Ignorant thug attempts to intimidate...

...Conservative MP... fails miserably...
MP Daryl Kramp says he refuses to be intimidated by Mohawk protester Shawn Brant's warning that the Conservative member is "not welcome on Mohawk land." Brant confronted Kramp at a sod turning event Saturday for the new skateboard park at Tyendinaga Mohawk Territory.

Kramp said the confrontation with Brant was fully expected based on the man's history. He said someone with a legitimate concern should discuss it rather than disrupt what was supposed to be a celebratory event.

"He thinks he can intimidate anyone he runs across and, obviously, that's not the case." Kramp said. He said Brant's comment "displays a shocking amount of ignorance."

Wag the Dog

I'm actually a little surprised the OPP didn't send a limo for him.
-- NAPANEE, Ont. -- Shawn Brant has turned himself in to the Ontario Provincial Police a week after he led Tyendinaga Mohawk demonstrators to blockade railways and roads in eastern Ontario for the National Day of Action.
Maybe we should be cutting Shawn some slack.

He's probably been working round the clock on his "made-for-tv movie" for CTV...
Brant said that despite his promise to appear for a bail hearing tomorrow, local OPP officers tried to arrest him yesterday morning.

"The OPP had blocked the road and, I believe, were attempting to try and do an intervention," he said, adding that he maintained a full force of men.

"They were telling me that I should get in the car and go with them and there was a warrant for me," Brant said.
THE OPP "BLOCKED THE ROAD!!!"... WHY, THAT'S OUTRAGEOUS... SOMEBODY OUGHTA CALL THE... uh... never mind...

Fortunately, our calm, sensitive, articulate hero was able to straighten out the "dumb as dogshit" racist cops...
"I told them that that was not the arrangement and I thought they should wait."

He said the officers abandoned their attempt, but that he was left frustrated with the situation.
Gee Shawn, you couldn't have been all that frustrated.... you didn't threaten to kill anybody this time.

Nevertheless, I think I speak for all Ontarians... indeed all Canadians, when I say... "I feel your pain."

We shouldn't feel slighted

Apparently Shawn Brant doesn't give a crap for Mohawk rules and regulations either...
A judge has returned control of a disputed Deseronto-area building and lands to the local Mohawk band council, but a defence lawyer says his clients will appeal the ruling.

In a judgment released Wednesday, Justice Lynn Ratushny of Ontario's Superior Court of Justice ruled the building and lands must be returned to the Mohawks of the Bay of Quinte (MBQ) band council.
It does appear though, that not all the Mohawks have rejected the jurisdiction of the wily white man's courts.
The case had been brought by MBQ Chief R. Donald Maracle on behalf of band council and all band members against Shawn M. Brant, his father, Ronald L. Brant, Andrew Clifford Miracle and Ohwistha Capital Corp.

The lands were occupied and the building built by the Brants, then sold to Miracle - though the judge wrote neither the Brants nor Miracle ever had band council's consent.

Ratushny, in her written ruling, explained that in 1992 the Brants approached the band with an offer to purchase the property in question.

Try this yourself some time... get a bunch of your buddies AND their deer rifles and TRY blockade a four lane highway for a couple of days.

One caveat though... if you're a middle aged white guy with a regular job and a family... the local SWAT Team is gonna drop you like a crazy girlfriend if you don't immediately disarm and assume the position.

And that's what the aboriginal community is doing right here.
-- TORONTO AND DESERONTO, ONT. -- Ontario Provincial Police shut down Canada's busiest highway early Friday morning west of Kingston due to native protesters in the area, who had earlier blockaded a section of secondary highway and a stretch of nearby railway track on the eve of the National Day of Action.

Friday morning, the Ontario Provincial Police closed Highway 401 both ways between Napanee and Belleville and were diverting traffic north onto Hwy 7 due to native protesters "being in the direct area, for safety reasons," said Sergeant Kristine Rae of the Smith Falls detachment.
I'm sure that's not the way Shawn Brant and his merry band of aboriginal thugs are gonna see it.

This is a coup for the terrorists. They just cut Canada's busiest transportation route and if the OPP are working from the same old playbook... we're gonna have to beg to get it back.
Thursday night, Mr. Brant's protesters lit two bonfires in the middle of the highway near Marysville, Ont., and had also parked pickups trucks, a van and school bus there.
Let's not forget Fidel Brant also claims his troops are armed and ready to shoot.

Time to call in "OUR" army.

Friday is about grievances aboriginal communities have with the federal government, not the province, he said.

"I remain hopeful that this national day of action will proceed in a peaceful and respectful way," McGuinty said, adding it will be up to provincial police to deal with any blockades or illegal activity.

Rebel without a brain

Canada's own version of Ismail Haniyeh is still making vague threats about disrupting "something or other" this holiday weekend.
-- DESERONTO, ONT. -- Mohawk protester Shawn Brant has emerged as a lonesome voice of hard-line native militancy, plotting major economic disruption as his way of making Canada sit up and listen.

Any move Friday to block thousands of commuters on Highway 401 or the CN rail line will depend on last-minute circumstances, police presence and safety issues, Mr. Brant said.

"We're going to have that expression of strength and solidarity across this country," he said in an interview at the quarry he occupied on disputed land last March near Deseronto, west of Kingston.

"Then we'll step back and say: 'You absorb this.' Because the next time we come out, it's going to be harder, it's going to be longer and it's going to have an impact on this economy that Canada can't imagine at this point.

"We've had enough."
Well Shawn, apart from the sexual imagery... you took the words right out of my mouth.

My guess is though, that Dalton McGuinty will let this one, whatever it turns out to be, slide too.

Which can only help the Conservative's chances in the coming Ontario elections.

So bring it on, baby.

A little short term pain will be worth the gain.

We encourage the participation of as many people as possible, in as many ways as possible.

Some people may choose set up lawn chairs and “relax on the tracks,” while others may choose to stand by the side of the road and pass out pamphlets and refreshments to motorists.

CN Rail is suing Shawn Brant, two other protesters, the Mohawks of the Bay of Quinte (MBQ) band council and other “unnamed parties” for blockades of its main eastern Ontario rail line.

Brant already faces criminal charges related to ignoring a court order to clear the tracks. He is charged with mischief, disobeying a court order and breach of recognizance. He is currently out on bail.
These charges are, of course, totally separate from his other offense of "uttering death threats."

It's still a farce mind you.

If a non-native tried publicly breaking the law like this... the local SWAT guys would have dropped him like a wet sack of shit.
